DISTANCE HEALTHCARE SERVICES AGREEMENT

1. PARTIES

This Distance Service Agreement ("Agreement") is concluded electronically between:

  • SERVICE PROVIDER:

  • CLIENT / USER ("Patient"):

    The natural person who requests and purchases online consultation / telemedicine services through the website [yourwebsite.com] and accepts the terms of this Agreement.

2. SUBJECT MATTER

The subject of this Agreement is the provision of online video consultation, preliminary medical assessment, and information services requested by the Client through the Provider's platform, in accordance with applicable consumer protection and electronic commerce legislation.

3. NATURE OF SERVICE & MEDICAL DISCLAIMER

  1. Preliminary Consultation: The services provided via video consultation are intended for preliminary advice, second medical opinions, and general medical evaluation.

  2. Not an Emergency Service: This service is NOT intended for life-threatening emergencies. In case of an urgent medical situation, the Client must immediately contact local emergency services (e.g., 112 / 911).

  3. In-Person Examination: Telehealth consultations cannot replace a comprehensive in-person clinical examination, physical diagnostic tests, or emergency interventions.

4. APPOINTMENTS, FEES & PAYMENT

  1. Fees: The fee for the consultation is specified during the booking process including all applicable taxes.

  2. Payment: Full payment must be completed through the online payment gateway prior to the scheduled consultation.

  3. Cancellations & Rescheduling:

    • The Client may reschedule or cancel the appointment up to [24/48] hours before the scheduled time without penalty.

    • Late cancellations or no-shows may be subject to the full consultation fee.

5. PRIVACY & DATA PROTECTION

All personal and health-related data collected in connection with the services are processed in strict compliance with the KVKK (Law on the Protection of Personal Data) and GDPR (General Data Protection Regulation), as detailed in our Privacy Policy and Explicit Consent Form.

6. JURISDICTION & DISPUTE RESOLUTION

In the event of any dispute arising out of or in connection with this Agreement, the courts and enforcement offices of [City / Country] shall have exclusive jurisdiction.

Contracting Parties

This Agreement is entered into between:

  • Service Provider: WM Health Istanbul, Email: info@wmhealthistanbul.com (hereinafter referred to as the "Provider").

  • Client / Patient: The natural person who accesses the platform, schedules an appointment, and purchases online consultation or healthcare coordination services via wmhealthistanbul.com (hereinafter referred to as the "Client").

By booking a service or completing an online payment, the Client acknowledges that they have read, understood, and agreed to all terms set forth in this Agreement.

Telehealth Consultations: WM Health Istanbul facilitates remote online video consultations, preliminary evaluations, and medical opinion services provided by qualified medical specialists across available medical fields (including Obesity and Metabolic Surgery, Surgical Oncology, IVF and Reproductive Health, Dental Care, Hair Transplantation, and Plastic and Aesthetic Surgery).

  • Preliminary Nature: The services rendered through this digital platform constitute a preliminary medical assessment and informational guidance. They are not intended to replace an in-person physical clinical examination, emergency medical diagnosis, or invasive surgical treatments.

  • Non-Emergency Notice: This platform is NOT designed for acute emergencies. In the event of an urgent or life-threatening situation, the Client must immediately contact their local emergency medical services (such as 112, 911, or the nearest emergency facility).

Fees and Payment

Pricing and Payment Terms

  • Consultation Fees: All service fees, consultation rates, and applicable taxes are clearly displayed to the Client on the appointment booking page prior to checkout.

  • Payment Processing: Full payment must be processed securely through authorized payment gateways (credit/debit card or specified electronic methods) before the appointment is confirmed.

  • Invoicing: Upon successful completion of payment, an electronic receipt or invoice will be generated and issued by WM Health Istanbul to the email address provided by the Client.

Cancellation and Refund Policy

Right of Withdrawal & Cancellation Policy

  • Right of Withdrawal (Exemption for Digital & Health Services): Pursuant to applicable consumer protection legislation and distance contract regulations, the statutory right of withdrawal does not apply once the online medical consultation service has commenced with the express prior consent of the Client.

  • Cancellations & Rescheduling:

    • The Client may cancel or reschedule their appointment free of charge by notifying WM Health Istanbul via info@wmhealthistanbul.com at least 24 hours prior to the scheduled consultation time.

    • Cancellations requested less than 24 hours before the appointment or failure to attend the scheduled video session ("no-show") may result in the forfeiture of the consultation fee, and no refund will be issued.

  • Refund Process: Eligible refunds approved by WM Health Istanbul will be credited back to the original payment method within 7 to 14 business days, depending on the Client's banking institution.
